Robert Roberson will testify before the Committee on Criminal Jurisprudence of the Texas House of Representatives.

The state’s highest civil court said it wants a lower court to resolve a separation-of-powers issue raised by a group of Texas lawmakers who subpoenaed the death row inmate the night before he was set to be put to death.

The development comes after several Republican and Democratic state lawmakers issued a subpoena for Roberson to testify at a hearing next week about his case.
